Chapter 15 - Mara’s criminal case

Mara accepted responsibility for some conduct and fought other allegations.

Evidence established:

She hid Sophie in maintenance cavity for six days.

She instructed Sophie not to leave.

She brought food irregularly.

She concealed child during CPS inquiry.

She failed to enroll Sophie in school.

She had photographed the Carters and considered private financial leverage.

No evidence she physically beat Sophie.

No fractures.

No starvation.

No sexual abuse.

No trafficking network.

Prosecutor charged:

Felony child endangerment based on unsafe concealment and evasion.

Interference with child-protection investigation.

Unlawful restraint misdemeanor/felony depending state; ultimately reduced in plea.

Mara’s defense emphasized:

Sophie had access to ventilation.

Blankets.

Water.

Food.

Mara entered nightly.

True.

Then danger:

Fire.

Medical emergency.

No adult immediately reachable from our side.

Sophie instructed not to reveal herself.

Unsafe.

Then Mara negotiated plea:

One felony child-endangerment count.

One misdemeanor interference count.

Other restraint count dismissed as part of agreement.

Sentence reserved for judge.

She also agreed to relinquish guardianship claims?

Criminal plea cannot automatically settle family rights, but she agreed separately in family proceeding not to seek restoration of guardianship, subject court approval.

Why?

Evidence.

Sophie’s fear.

Her finances.

And one unexpected reason:

She admitted Caroline had written:

If the Carters are safe people and the embryo was theirs, Sophie deserves to know them.
